Privacy Policy

Your privacy is important to us, and we want you to be informed about our privacy practices. This Privacy Policy describes how Ode To Art ("OTA" or "we" or "our" or "us") may collect and use your information, and your choices about privacy when you use the OTA website, products, and services (collectively, the "Services"). This Privacy Policy is part of our Terms of Use, which can be viewed at odetoart.com/text.php?v=termsofuse. Any capitalized terms that are used but not otherwise defined in this Privacy Policy have the same meaning given to them in our Terms of Use. By accessing or using the Services in any manner, you agree that your information may be collected, stored, shared, and used as described in this Privacy Policy and in our Terms of Use. Please read this Privacy Policy carefully, and feel free to contact us if you have any questions about this Privacy Policy or your use of the Services.

Personal Information
In this Privacy Policy, "Personal Information" means information that can be associated with a specific person and could be used to identify that person. You may need to provide certain Personal Information in order to register for an OTA account or use some of the Services. Personal Information includes but is not limited to your name, username, email address and other contact information. You may choose not to provide certain Personal Information, but this may prevent you from registering for an account or using some of the Services. Under this Privacy Policy, Personal Information does not include any information that has been made anonymous or aggregated so that it can no longer be used to identify a specific person.

Collection of Information

Information You Give Us: We may collect and store any information that you enter on the Services or provide to us in any other way. This includes but is not limited to:

  • information you provide when registering for an OTA account, or in your profile and account settings, including your name, username, email address, postal address, phone number, bio, and website URL;

  • information you provide about your preferences and interests;

  • information you enter in forms on the Services;

  • information contained in User Content that you provide on or through the Services;

  • information you may provide to us through other social media services;

  • transaction information, including your buying activity;

  • inquiry information, including when you use the Services to contact us or other Users;

  • information based on your use of any other features of the Services;

  • email, phone or any other communications between you and us.

Information Collected Automatically: We automatically collect certain information about how you access and use the Services. Examples of this information may include but are not limited to Internet browser, operating system, device, and application identifiers, IP address and geo-location information, access times and dates, referring and exit pages, click-stream data, search queries, pages viewed, time spent on pages, bounce rate, and login frequency.

Information from Cookies, Web Beacons and Other Technologies: We may use cookies, web beacons and other technologies to collect, store, and analyze information. Cookies are data files placed on your computer or other device to collect or store information. We may use cookies to collect information about how you access and use the Services. We may also use cookies to store information, including but not limited to your account and profile settings, to customize the Services and make them more convenient. We use both session cookies and persistent cookies. Session cookies expire when you close your browser, and persistent cookies remain on your device until they expire or are deleted. Most browsers have an option to disable cookies, but disabling cookies may prevent you from using some of the Services (for example, logging in to an OTA account requires cookies). We may also use web beacons (also known as "pixel tags" or "clear GIFS"), which are pieces of code or pixels embedded in a web page or email, and other similar technologies, to collect information about how you access or use the Services, or to identify when emails that we send you have been received, opened or clicked through. We may also have select third-party service providers place or operate cookies, web beacons or similar technologies on our behalf, to help us collect, store, and analyze information about how the Services are accessed and used. Unless we specifically indicate otherwise, this Privacy Policy covers our use of these technologies only, and does not cover the use of cookies or other technologies by third parties.

Information from Other Sources: We may receive or collect additional information about you from third parties, including but not limited to demographic information, additional contact information, and credit history information from credit bureaus or other sources, and we may add this information to other information in our records, as permitted by law. Our uses for such information may include but are not limited to User authentication, fraud detection and prevention, credit-related decisions, and customer support.

Information from Mobile Use: You may be able to access the Services on a mobile device, for example, through a mobile application or a mobile web browser. When you download or use our mobile applications or otherwise access the Services on a mobile device, we may collect information about your location and mobile device, including a unique identifier for your device. We may use this information to customize the Services, Content, and marketing for your location. Most mobile devices allow you to turn off location services, and your choices for location services may vary depending on your mobile device.

Use of Information

Our main purposes for collecting Personal Information from you are to administer and operate the Services, to provide the Services to you, to communicate with you, and to provide you with customer support. In addition to other uses described in this Privacy Policy, and other uses to which you may otherwise consent, you agree that we may use your Personal Information to:

  • provide the Services to you, including new Services that we may later develop;

  • provide you with customer support;

  • customize, measure, improve, and develop the Services, Content, and marketing;

  • contact you by email, postal mail, telephone, fax, mobile devices and/or text message (SMS) to address issues with your account or the Services, collect fees, resolve disputes, or for other purposes permitted by law;

  • contact you by email, postal mail, telephone, fax, mobile devices and/or text message (SMS) to inform you about the Services, and to send you marketing communications, updates about the Services, and promotional offers;

  • facilitate your participation in contests, sweepstakes, and other promotions;

  • facilitate your transactions, inquiries, and communications with us and other Users;

  • perform other functions as described when the Personal Information is collected.

Accounts and Profiles

To register for an OTA account, you will need to provide your full name and a valid email address. If you have an account, you may access, add, remove or update certain information in your profile and account settings, as indicated on the Services. It is your responsibility to update all such information as necessary to keep it accurate and current. To facilitate interaction through the Services, certain information in your profile may be made public on or through the Services, including but not limited to your name, username, bio, city or town, website, and profile picture. We may provide privacy settings to control if and how certain profile information is shared on or through the Services, and you should review your profile and account settings regularly to be informed of your current choices (and please note that public profile information may also be indexed by third-party search engines like Google). When you update information in your profile and account settings, we may keep a record of the previous version. If your account is terminated or you otherwise stop using the Services, we may keep a record of any Personal Information and/or other information associated with you and/or your account, as required or permitted by law, for purposes consistent with this Privacy Policy.

Communication Preferences

We provide registered Users with settings on the Services to control whether they receive certain communications from us. You may choose to stop receiving promotional emails from us at any time by following the unsubscribe link in those emails, by changing the communication preferences in your profile and account settings, or by contacting us. Please note that such requests may take up to ten (10) business days to process, and you may continue to receive promotional emails from us during that time.

Other Websites and Services

The Services may include links and features that enable you to access other websites or services, and other websites or services may include links to the Services. If you login to the Services through another social media service or you link your OTA account to your account on another social media service, we may receive or collect your username on that service and other information that you make publicly accessible through that service, which may vary depending on your privacy settings on that service. By associating your account on another social media service with your OTA account and authorizing us to access this information, you agree that we may collect, store, share, and use information from such other service in accordance with this Privacy Policy. Please note that this Privacy Policy does not apply to any website or service that we do not own or control, including but not limited to any other social media service. We suggest that you read the privacy policies of any other websites or services that you access or use to be informed of how they may use your information.

Favourites and Follows

The Services may include features that enable you to save or designate your "favorite" artists, designers or other creators, artwork or other items, or categories of artwork or other items. The Services may also include features that enable you to "follow" artists, designers or other creators, or categories of artwork or other items. You may be able to share information about your favorites or follows on or through the Services, as described by us in connection with these features, or as otherwise indicated in your profile and account settings. We may provide privacy settings to control if and how certain information about your favorites, follows, or followers is shared with others, and you should review your profile and account settings regularly to be informed of your current choices. These features may also include privacy settings that enable you to make choices at the time the features are used, as indicated on the Services.

Inquiries and Transactions

When you use the Services to perform a transaction with us, we may share your name, email address and other contact information with the primary seller ("Artist") to facilitate your transaction with them. Sometimes additional information about you may be shared with the primary seller when you use the Services to contact them or perform a transaction with them. For example, the Artist may be able to obtain or receive information about your location, interests and other information, as described by us in connection with these features of the Services, or as otherwise indicated in your profile and account settings. We may provide privacy settings to control if and how certain information about you is shared with others in these contexts, and you should review your profile and account settings regularly to be informed of your current choices.

Payment Information

If you use the Services as a buyer, or you register for certain Services, you may be required or permitted to provide certain payment information, such as your credit card number, type, and expiration date. We do not store credit card information entered on the Services. Such information is stored by a third-party payment processor, and the use and storage of such information will be subject to the payment processor's applicable terms and conditions and privacy policy, as further described in our Terms of Use. We do receive certain information from the payment processor, including a unique token that we connect with your account to authorize your purchases, and in certain cases, the last four digits of the credit card number associated with that token, in order to prevent fraudulent transactions and identity theft.

Service Providers

We may contract with third-party service providers that assist us to provide some of the Services, or that perform some services for us related to the Services, and these service providers have access to Personal Information as needed to perform their functions for us. Examples may include but are not limited to order fulfilment, package delivery, payment processing, bill collection, fraud investigation, email and postal mail administration, customer service assistance, web and data analytics, and database hosting services. As we are legally bound to maintain proper accounting records, we are limited with respect to the data we may remove from our system. For invoice data created within five (5) years, we may not remove or alter any data related to you.
